The ability of a prosecutor to anticipate and rebut defenses provides tactical and strategic advantages at trial and it is a necessary step in successful case preparation. Building from the analytical advocacy concepts taught during NDAA’s first Trial Advocacy Academy session, this presentation will aim to provide you with an understanding of the most common defenses raised and practical tips on how to rebut potential defenses at every stage of your case.

David Greenwald

Douglas County District Attorney’s Office
David Greenwald is a 2012 graduate of the University of Miami School of Law. Currently, he is a Senior Assistant District Attorney in the Douglas County, Kansas District Attorney’s Office where he heads up the drug unit, specializing in drug distribution cases and drug overdose homicides. David started his career in municipal court, focusing on misdemeanors and DUI prosecution before moving to the Wyandotte County District Attorney’s Office in Kansas City, Kansas where he focused on prosecuting all manner of felonies, with an emphasis on violent crime. As a member of the Violent Crime Task Force, David specialized in prosecuting gang cases and homicides. He moved to the Johnson County District Attorney’s Office in 2019 to prosecute traffic crashes and fatalities before taking his current role in 2021. David presented to the Kansas County and District Attorney’s Association in 2023 focusing on prosecuting fentanyl overdose cases.
When he isn’t at work, David loves spending his time with his wife, Danee, and three amazing children, Jack, Teddy, and Izzy. He hosts a podcast covering Sporting Kansas City and writes for the Kansas City Soccer Journal, and can tell you obscure sports facts that you didn’t ask for on any variety of different events, teams, and years.

This course is approved for credit in Illinois, Kansas, North Carolina, Ohio, Pennsylvania, Tennessee, Texas, and Virginia. NDAA has applied for CLE credit in Mississippi based on state requirements and guidelines. All other attorneys seeking self-study CLE credit should contact their state bar for more information.
